Regulations

§ I. GENERAL PROVISIONS

1. These regulations (hereinafter referred to as the "Regulations") define the conditions for providing services electronically and the rules for protecting the personal data of individuals using the services (hereinafter referred to as the "Services") provided by Sushi Bistro (Best Food Sp. z o.o., ul. Pasaż Stokłosy 11 lok. U 12, 02-787 Warsaw, NIP 951-238-38-36), hereinafter referred to as the "Service Provider".

2. The Service Provider undertakes to provide services in accordance with these Regulations.

3. Users using the Services are obliged to comply with the provisions of the Regulations.

 

§ II. REGISTRATION

1. The process of providing the Services begins when the User registers on the sushibistro.pl website. Registration is tantamount to acceptance of these Regulations and is also a condition for accessing the offered Services.

2. The User registering on the website is obliged to provide personal data that is accurate and does not infringe any rights.

3. After successfully completing the Registration process, the User receives a personal account on the Sushibistro.pl website.

4. The Service Provider has the right to delete any account created on the website at any time if it violates the law, these Regulations, or the interests of the Service Provider.

5. The User is obliged not to disclose their account details to any third parties. The User is solely responsible for any damages caused by such disclosure.

 

§ III. TERMS OF SERVICE PROVISION BY THE SERVICE PROVIDER

1. The Service Provider enables the User who has registered on the Sushibistro.pl website to place an order for products available at sushibistro.pl. The parties to the agreements in this case are the Service Provider and the User.

2. In the case of a correct order, the User will receive an order confirmation at the provided phone number.

3. From the moment the Service Provider receives the order, they are solely responsible for its correct execution. The Service Provider is not responsible for incorrect order execution resulting from the provision of incomplete or incorrect contact information in the registration form.

4. Withdrawal of an order is only possible by phone at the number 690 246 299. In case of order cancellation, the User is obliged to inform the Service Provider immediately after receiving the order confirmation.

5. Changing the content of a placed order is not possible.

6. In case the User places a false order by providing false data, the Service Provider has the right to inform law enforcement authorities.

 

§ IV. PAYMENTS AND DELIVERY

1. The User can pay for the order using payment cards or cash. In the case of cash payments, the payment is made upon receipt to the hands of the delivery person of the products ordered by the User.

2. The User can pay for the order using the online payment system.

3. Orders placed for a specific time can be fulfilled within a +/- 15-minute time frame.

 

§ V. RIGHTS AND OBLIGATIONS OF THE SERVICE PROVIDER

1. The Service Provider undertakes to provide uninterrupted Services during the working hours of the Service Provider specified on the sushibistro.pl website.

2. The Service Provider reserves the right to temporarily suspend the provision of services without providing a reason.

3. The Service Provider reserves the right to send communications regarding potential technical issues of the service to the email addresses provided by the Users.

4. The Service Provider reserves the right to delete the User's account, thus ceasing the provision of services in case of violation of the Regulations or if the provision of services is impossible due to the User's fault.

 

§ VI. PRIVACY

1. The Service Provider processes the User's personal data solely for the proper execution of the services specified in these Regulations, using the personal data necessary for their implementation, as specified in the registration form made available to the User, in accordance with the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended).

2. Users' data is processed in compliance with all required security principles.

3. Users' data will NOT be transferred to any third parties.

 

4. Users' data may be used by the Service Provider to send commercial information exclusively from the Service Provider, only if the User consents.

5. In accordance with the Act of 29 August 1997 on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended), the User consents to the processing and storage by Best Food Sp. z o.o., ul. Pasaż Stokłosy 11 lok. U 12, 02-787 Warsaw, of the personal data provided in the registration form on the sushibistro.pl website.

6. In accordance with the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended), the User consents to receiving commercial information exclusively from the Service Provider at the email address provided by the User during Registration within the service run by Best Food Sp. z o.o.

 

§ VII. COMPLAINTS AND FINAL PROVISIONS

 

1. The User has the right to file a complaint regarding products and services provided by the Service Provider in case of non-compliance with the order or these Regulations.

2. Complaints can be submitted electronically to the address biuro@sushibistro.pl or by phone at 690 246 299. When submitting a complaint, the User is required to provide their name, surname, address, email address, phone number, User ID in the System (login), and describe the subject and reason for the complaint. In the case of product complaints, the User must also provide proof of purchase (receipt).

3. Complaints are reviewed within 14 days from the date of submission. The User will be informed about the result of the complaint process via email to the provided email address or by phone.

4. These Regulations come into effect on October 30, 2014.

 

5. The Service Provider has the right to change the Regulations. In such a case, the changes to the Regulations come into effect 7 days after the new Regulations are posted on the sushibistro.pl website.

6. Users will be informed about changes to the Regulations electronically and on the login page of the sushibistro.pl website. If the User does not agree with the new Regulations, they have the right to immediately terminate the agreement between the User and the Service Provider.

7. In matters not regulated by the Regulations, all mandatory provisions of Polish law shall apply.

 

§ VIII. PAYMENTS

 

1. The User can make a cash payment upon delivery by the Partner or at the Partner’s location (in case of self-pickup orders) or pay for the order using the Payeezy Payment System at the time of placing the order on the Website. The PayPal system is also available within the Payeezy system.

2. All prices listed on the website include VAT (value-added tax).

3. In the case of choosing electronic payment:

    a. Payments through the Payment System can only be made by persons authorized to use the specific instrument used for payment, particularly the cardholder in the case of card payments. Any detected abuses will be reported directly to the relevant law enforcement authorities.

    b. The Service Provider provides a transaction form supplied by the Payment System Operator; the data from the form is automatically transmitted to the Payment System partner via the Payment System.

    c. Upon selecting the electronic payment method, the User is automatically redirected accordingly: for card payments, to a window for entering the necessary payment data; for online bank transfers, to the login page of the relevant bank.

    d. To complete the payment, the User should confirm the payment on the relevant Payment System partner’s website according to their terms. Any changes made to the automatically filled payment form may result in the payment not being processed.

4. All electronic payments are made according to the regulations of the Payment System Operator or Payment System partner, and the Service Provider is not responsible for their accuracy.

5. Cash payments are made to the delivery person of the ordered products, upon receipt.

6. If the Service Provider is unable to fulfill the order to the Partner, the User will receive a full refund for the payment made through the Payment System from the Service Provider. The refund will be processed no later than 72 business hours from the day the Service Provider is informed of the non-fulfillment of the order (for bank transfers) and within 14 business days for card payments. The date of the refund is considered the date the Service Provider issues the refund instruction to the Payment System Operator.

7. Payment System partners and the Payment System Operator reserve the right to refuse to process payments made by the User, particularly in cases of doubts regarding the legality of the transaction or the payment itself. For these reasons, the Service Provider may also refuse to accept the payment.

8. The User acknowledges that the Payeezy Payment System Operator and its partners conduct financial reliability assessments of persons intending to make card payments and may vary the terms of service or impose certain conditions based on the User’s risk classification. Therefore, the Payeezy Payment System Operator reserves the right to refuse to process a payment in justified cases.

9. The Payment System Operator is not responsible for delays in transferring payments or authorization responses caused by issues arising after the User has initiated the payment, as well as for non-fulfillment or delays in transferring funds or verifying data, particularly due to the User providing incorrect or incomplete data that prevents the transaction from being completed, or delays resulting from other events beyond the control of the Service Provider or the Payment System Operator.

 

§ IX. Regulations of the "Sushi Bistro" Loyalty Program

 

Section I: General Provisions

1.1. These Regulations define the rules of the "Loyalty Program," organized by: Best Food Sp. z o.o., ul. Pasaż Stokłosy 11 lok. U 12, 02-787 Warsaw, NIP 951-238-38-36.

 

1.2. These Regulations constitute a contract template within the meaning of Art. 384 et seq. of the Civil Code and are made available to the Participant free of charge before joining the Referral Program, in a manner allowing their storage and reproduction in the ordinary course of activities, via a website available on the Internet at sushibistro.pl.

1.3. Participants are obliged to read the content of these Regulations and comply with its provisions, which they confirm by making a statement during the activation of the customer account.

 

Section II: Definitions

2. In the absence of separate regulations, the terms used in these Regulations should be understood as defined in the Regulations specifying the rules for using the sushibistro.pl service. For the purposes of these Regulations, the following definitions are additionally established:

2.1. **Organizer** - Best Food Sp. z o.o., ul. Pasaż Stokłosy 11 lok. U 12, 02-787 Warsaw, NIP 951-238-38-36.

2.2. **Loyalty Program** - a voluntary program regulated by these Regulations, consisting of awarding Customers points for orders placed through the sushibistro.pl website.

2.3. **Participant** - an entity using the services provided by the Organizer, having an active account on the sushibistro.pl website, not being an employee of the Organizer, who has activated the Loyalty Program.

2.4. **Points** - Participants receive 1 point for every 5 PLN spent on an order. Points from subsequent orders are accumulated proportionally to the value of the orders. Collected points can be exchanged at any time for a discount, the amount of which is determined by the number of points collected.

 

2.5. **Discount** - the Participant can reduce the order value by the amount of points collected at any chosen time, or continue collecting points until they decide to use them.

 

Section III: Participant Rules

3.1. Anyone with an active account on the sushibistro.pl website, who is not an employee of the Organizer, can become a Participant. When activating the program, the Participant must confirm the accuracy of the data provided during the account registration process and confirm that they have read these Regulations. The Participant will inform the Organizer of any changes to the data provided. In case of incorrect data, the Organizer reserves the right to block the account. If the data is not updated within 3 days of the account being blocked, the Organizer is entitled to delete the Participant's account with false data. In such a case, the Participant loses the granted points and the right to use them.

3.2. Points obtained under the Loyalty Program can be combined with other promotions of the Organizer, e.g., the Referral Program.

3.4. Points collected in the Loyalty Program are not awarded for amounts accumulated under the Referral Program.

 

Section IV: Program Rules

4.1. The Organizer specifies that the Loyalty Program is valid until May 31, 2017. Funds collected by Participants will remain in their accounts for 6 months from the date the points are awarded for a specific order.

4.2. The Organizer reserves the right to disable the Loyalty Program at any time. However, points earned according to the regulations will not be canceled. The Organizer also reserves the right to recalculate and correct points awarded due to errors, such as system errors or actions inconsistent with the regulations.

 

§ X. Regulations of the Sushi Bistro Referral Program

 

Section I: General Provisions

1.1. These Regulations define the rules of the "Referral Program," organized by: Best Food Sp. z o.o., ul. Pasaż Stokłosy 11 lok. U 12, 02-787 Warsaw, NIP 951-238-38-36.

1.2. These Regulations constitute a contract template within the meaning of Art. 384 et seq. of the Civil Code and are made available to the Participant free of charge before joining the Referral Program, in a manner allowing their storage and reproduction in the ordinary course of activities, via a website available on the Internet at sushibistro.pl.

1.3. Participants are obliged to read the content of these Regulations and comply with its provisions, which they confirm by making a statement during the activation of the customer account.

 

 Section II: Definitions

2.2. **Referral Program** - a voluntary program regulated by these Regulations, establishing cooperation between the Organizer and the Participant with the aim of acquiring new customers for the Service.

 

2.3. **Participant** - an entity using the services provided by the Organizer, having an active account on the sushibistro.pl website, not being an employee of the Organizer, who has activated the Referral Program.

2.4. **Referred Customer** - a customer who creates a new account on the sushibistro.pl website, who has never previously had an active account on sushibistro.pl, and who has activated the user account on the website as a result of the Participant's actions, confirmed by indicating the Participant's code during registration. A Referred Customer cannot be a consumer who already has an active account on sushibistro.pl.

2.5. **Code** - a unique code identifying the Participant as a user of the sushibistro.pl website.

2.6. The Participant receives a discount of 10 PLN in the form of funds on their sushibistro.pl account for each Referred Customer who creates an account on sushibistro.pl and places an order. Each Referred Customer using the Participant's code during account registration on sushibistro.pl receives a discount of 10 PLN in the form of funds on their account for the first order. The funds cannot be withdrawn and can only be used for orders on sushibistro.pl.

 

 Section III: Participation Rules

3.1. The Referral Program covers the cooperation rules for acquiring new customers for the Organizer by Participants recommending the services offered through the sushibistro.pl website. The Participant is not an agent of the Organizer and is not authorized to make or receive any declarations of will or knowledge on behalf of the Organizer, nor to receive any benefits on behalf of the Organizer.

3.2. Any user of the sushibistro.pl website with an active account, who is not an employee of the Organizer, can become a Participant. The Participant must confirm the accuracy of the data provided during the user account registration process and confirm having read these Regulations. The Participant will inform the Organizer of any changes to the provided data. In case of incorrect data, the Organizer reserves the right to block the account. If the data is not updated within 3 days of the account being blocked, the Organizer is entitled to delete the Participant's account with false data. In such a case, the Participant loses the granted funds and the right to use them.

3.3. Funds obtained under the Referral Program can be combined with other promotions of the Organizer, e.g., the Loyalty Program.

3.4. Loyalty Points are not awarded for funds accumulated under the Referral Program.

 

 Section IV: Referral Rules

4.1. Participants acquire new customers by recommending the services offered through the sushibistro.pl website by the Organizer. The Participant is not an agent of the Organizer and is not authorized to make or receive any declarations of will or knowledge on behalf of the Organizer, nor to receive any benefits on behalf of the Organizer.

 

4.2. The Organizer specifies that the Referral Program is valid until November 30, 2016. Funds accumulated by Participants under the Referral Program are valid until the last day of the month following the month in which they were granted.

4.3. The Organizer reserves the right to disable the Referral Program at any time. However, funds earned according to the regulations will not be canceled. The Organizer also reserves the right to recalculate and correct points awarded due to errors, such as system errors or actions inconsistent with the regulations.

 

 § IX. Regulations of the New Loyalty Program "Sushi Bistro"

 

Section I: General Provisions

1.1. These Regulations define the rules of the "New Loyalty Program," organized by: Best Food Sp. z o.o., ul. Pasaż Stokłosy 11 lok. U 12, 02-787 Warsaw, NIP 951-238-38-36.

 

1.2. These Regulations constitute a contract template within the meaning of Art. 384 et seq. of the Civil Code and are made available to the Participant free of charge before joining the New Loyalty Program, in a manner allowing their storage and reproduction in the ordinary course of activities, via a website available on the Internet at sushibistro.pl.

1.3. Participants are obliged to read the content of these Regulations and comply with its provisions, which they confirm by making a statement during the activation of the customer account.

 

 Section II: Definitions

2. In the absence of separate regulations, the terms used in these Regulations should be understood as defined in the Regulations specifying the rules for using the sushibistro.pl service. For the purposes of these Regulations, the following definitions are additionally established:

2.1. **Organizer** - Best Food Sp. z o.o., ul. Pasaż Stokłosy 11 lok. U 12, 02-787 Warsaw, NIP 951-238-38-36.

2.2. **New Loyalty Program** - a voluntary program regulated by these Regulations, involving granting customers free sushi sets as specified in these regulations upon reaching the minimum order value in a given calendar month. Only orders placed online via sushibistro.pl are counted towards the program.

2.3. **Participant** - an entity using the services provided by the Organizer, having an active account on the sushibistro.pl website, not being an employee of the Organizer, who has activated the New Loyalty Program.

2.4. **Participant's Entitlements** - Participants are entitled to receive free bonus sets, provided they place orders of the required value for the bonus set within a calendar month:

   - "Yellow Set" - for orders totaling 400 PLN in a calendar month.

   - "Special Set 2" - for orders totaling 600 PLN in a calendar month.

2.5. When a Participant chooses one of the sets, the turnover on the loyalty program bar will be reduced by the amount corresponding to the given set. For the "Yellow Set," the turnover will be reduced by 400 PLN, and for the "Special Set 2," by 600 PLN.

2.6. The Organizer reserves the right to change the sets and thresholds at any time, with the provision that such changes can only be made for the following calendar month.

 

Section III: Participation Rules

3.1. Any user of the sushibistro.pl website with an active account, who is not an employee of the Organizer, can become a Participant. When activating the program, the Participant must confirm the accuracy of the data provided during the user account registration process and confirm having read these Regulations. The Participant will inform the Organizer of any changes to the provided data. In case of incorrect data, the Organizer reserves the right to block the account. If the data is not updated within 3 days of the account being blocked, the Organizer is entitled to delete the Participant's account with false data. In such a case, the Participant loses the granted funds and the right to use them.

 

Section IV: Program Validity

4.1. The Organizer specifies that the New Loyalty Program is valid until May 31, 2018. Funds accumulated by Participants are reset at the end of each calendar month.

4.2. Participants who are entitled to a free set at the end of the calendar month are obliged to use it within 60 days from the last day of the month in which the set was granted.

4.3. The Organizer reserves the right to disable the New Loyalty Program at any time. However, sets granted according to the regulations will not be canceled. The Organizer also reserves the right to recalculate and correct the value of orders granted due to errors, such as system errors or actions inconsistent with the regulations.

 

Section V: Entry into Force and Final Provisions

5.1. These Regulations come into force on June 1, 2017, and replace the previous Loyalty Program regulations.

6.1. In accordance with the provisions of the Referral Program Regulations (regarding the program that ended on May 31, 2017), points awarded under the Referral Program remain on the user's account and can be used within 6 months from the date of their award. After this period, they will be canceled.

 

§ X. Regulations for the Purchase and Redemption of Vouchers

 

1. **Voucher Values**: SUSHI BISTRO vouchers are available in two denominations: 50 PLN and 100 PLN.

2. **Validity Period**: Vouchers have a specified validity period, which is indicated on the back of the voucher.

3. **One-Time Use**: Vouchers are for single use only and must be used in their entirety. If the purchase amount is less than the voucher's value, the entire voucher value is considered used. If the order value exceeds the voucher's value, the voucher value will be deducted from the total purchase, and the remaining balance must be paid.

4. **Order Placement**: When placing an order online, in-person, or by phone, the customer must inform the staff about the possession of a voucher or indicate in the comments section when ordering online that they have a voucher.

5. **Voucher Submission**: Upon receiving an order placed using a voucher (whether in the restaurant, for delivery, or for pickup), the customer must hand over the voucher to the restaurant employee issuing the order.

 

6. **Menu Applicability**: Vouchers are valid for the entire menu of SUSHI BISTRO at the restaurant where the voucher was issued.

7. **Redemption Location**: Vouchers can only be used at the SUSHI BISTRO restaurant where they were issued. The address of the restaurant is printed on the back of the voucher.

8. **Non-Exchangeable**: Vouchers cannot be exchanged for cash.

9. **Non-Cumulative**: Vouchers cannot be combined when placing a single order. This means that if a customer has multiple vouchers, only one voucher can be used per order.

10. **Acceptance of Terms**: By using a voucher, the customer confirms that they have read and accepted these regulations.
